SCOTUS CARE?

SOOOO….The Supreme Court came down with a decision (and I do mean ‘down’)….

Justice Scalia says we might as well call it SCOTUS CARE.  I see his point, do you?

Justice John Roberts, who Obama did not vote for, has voted Obama’s way twice now.

Roberts says.“In every case we must respect the role of the Legislature, and take care not to undo what it has done,” the Court ruled. “Congress passed the Affordable Care Act to improve health insurance markets, not to destroy them. If at all possible, we must interpret the Act in a way that is consistent with the former, and avoids the latter.”

To me, that means “Look, this is a good health care plan so, legal or not, constitutional or not, I’m goin’ with it, because I’d hate to go against Congress and the people.  I’d hate to destroy the markets even if they’re unconstitutional.”   Which seems to me to be totally unconstitutional.

    You are correct Z.
    Think back over the start of Nazi control in Germany of their version of the congress. They controlled it a n rammed through the laws that would exterminate the Jews and start WWII.
    Their high court did not uphold the current constitution that protected the people. The Nazis voted for the death of Germany and their courts upheld it.
    Are we seeing this again with our SCOTUS?

    By the way, I pay a LOT of money for my COBRA and was just told it’s going up again “to pay for all the mandates we have to cover…”
    I believe that the amount of folks MAD at the ACA will become much larger by the month and that when those who are finally getting insurance they couldn’t afford find they suddenly still can’t afford it, there’s going to be hell to pay. Like my insurance agent (who retired early because of it) says, ‘wait till people start getting really sick and realize they’re barely covered’…
    But then Sanders is already saying “This shows we really do need single-pay”….and that will happen. And that will destroy our economy. finally.

    Frank, thanks for that input; as you know the Germans don’t have a constitution, but you’re totally right on this…they certainly did vote against the protections of German Jews (who were every bit as GERMAN as non Jewish Germans were…it makes me crazy when I hear quite often “the Germans and the Jews”..)

    At this point, the President and congress can just issue verbal dicta. Why bother with actually writing the laws down on paper?

    The Court holds that when the Patient Protection and Affordable Care Act says “Exchange established by the State” it means “Exchange established by the State or the Federal Government.” That is of course quite absurd, and the Court’s 21 pages of explanation make it no less so…. Words no longer have meaning if an Exchange that is not established by a State is “established by the State.” It is hard to come up with a clearer way to limit tax credits to state Exchanges than to use the words “established by the State.” And it is hard to come up with a reason to include the words “by the State” other than the purpose of limiting credits to state Exchanges.

    Scalia sums up: “Under all the normal rules of interpretation, in short, the Government should lose this case. But normal rules of interpretation always seem to yield to the overriding principle of the present Court: The Affordable Care Act must be saved… We should start calling this law SCOTUScare.”

    Conservatives constantly say that if one more member of the Supreme Court were to be appointed by a Democrat, the balance of power in America would radically shift. That appears to be an exaggeration. Republican presidents have been quite capable of undermining the Constitutional order with their own appointments. And those appointments have done their damndest to destroy whatever is left of that order.

    Other parts of the economies get subsidized so sadly why would this be different? Now I’m waiting for someone to do something and fix it. I already lost my plan and my new plan’s company is leaving the insurance market because of this crap and am paying 40% more than last year.

    I’m paying twice as much as I was in 2009 and getting less. I read the other day that 30 million people are without health insurance and they won’t be able to get it. The number without health ins will float around 30 million. obamacare does nothing it was billed to do and it has not even yet begun to suck.

  15. We have always relied on the media to blow the whistle when anyone in Government does something wrong, and we keep asking why they haven’t under this administration. I really believe a lot of the huge $8 trillion debt Obama incurred went to the media as “donations”, thereby buying their loyalty. I remember awhile back one publication stating they were NOT recipients of any government funding, which sent up a big red flag in my mind. Ladies and gentlemen, they have sold us out.

    Ya, my ins. agent quit because he had clients he tried to help through the Obamacare opening days and, when they finally could reach someone, they were told to shine their agents on, “You don’t need them!” Plus, he said the floodgates are going to BURST when people who think they’ve lucked out with OBamacare and their subsidies get REALLY sick, they will be SCREWED…got to go to Bakersfield for a hospital, their own doc doesn’t take that insurance, their other doc retired early…etc etc.
    And still, my great buddy who just graduated UCLA Med School tells me almost ALL the students love Obamacare…..at least those who understand/hate it aren’t speaking up and the profs are TOUTING its virtues. idiots.

    ALL You great guys (I’m so grateful you’re here and writing this great stuff)…: The bottom line is we all depended on the SCOTUS to judge ON THE LAW, ON THE CONSTITUTION and they aren’t anymore. IMAGINE a Supreme Court Justice saying “Well…gee, it’d be such a mess to overturn this part of the plan that I’m just going to define ‘state’ this way, and call it a day”……

    I wouldn’t want to be John Roberts in Washington today. I hope his conscience is REALLY bothering him. and, while I’m at it: It’s NOT A TAX 🙂

    So the question I have is this: where does the word “affordable” apply to Obama Care. We should perhaps regard the words affordable care in the same way we regard the words government services.

You could tell a fondness with the panel even though they didn’t agree much at ALL with him, and that kind of chemistry counts on TV…it’s not a news show, it’s an entertainment show which allows us to see their viewpoints , which are almost always interesting.
