Roe v Wade………and SCOTUS, of course

Mark Levin so well explains why Trump nor the Left need to make ABORTION the big deal with his coming appointment to the Supreme Court.  I’m going to explain why I think they WILL, however:

Sadly, Trump’s already today signaled to  Susan “Partial Birth is Okay!” Collins (do you know how awful partial birth IS?  She was for it…one of only 3 Republicans who voted not to ban it) and Lisa Murkowski that he has “broadened the list of possible Justice candidates”…obviously, it was a message to them that said “Don’t worry, I’ll find someone softer on it.”

Sounds like he’s caving already!  But Trump had better DARNED WELL be careful because his base is EVERYTHING to him and, possibly, the Midterms, so DO NOT BLOW IT ON THIS, MR. TRUMP.  I have a feeling he’s playing them along, however, because he’s more aware of the wishes of his base on this subject than we are, that’s for sure.

It would be very unusual if Roe v Wade even came to the SCOTUS.  Ever.   Most people with their eyes on the court, from both sides of Roe v Wade, know this.

The SCOTUS gets from 7-8,000 cases a year for their review.  They pick about 100 and send the rest back.   They’ll probably send this one back just because it’s huge and because they’ll not want to ‘go through that again’;  most say “this is settled law”    Not sure that’s pertinent, but that’s what’s said.

SO HERE IS WHAT I THINK:  Is the Left going to use ROE v WADE just to advertise to women and most liberals that THEY ARE MORE OPEN MINDED and, after all,  WOMEN HAVE A RIGHT TO DECISIONS ABOUT THEIR OWN BODY!!, knowing full well it won’t come up but they just plain DO NOT WANT A CONSERVATIVE ‘TRUMP COURT’ to decide anything for the next 40 years?

The danger in high courts reversing decisions of their predecessors is that it becomes a political teeter-totter with a simple Senate 51/49 majority picking judges for the primary purpose of reversing or ignoring rulings based on fads or whims.

Doubt very much the SCotUS is interested in deep-sixing established precedent: once you enter that no-man’s-land, where does it stop.

To me the whole thing is one of those “there ain’t no answer” quandaries. Making abortions illegal wouldn’t stop the practice, but simply make ridding oneself of an inconvenient pregnancy a privilege of the well-to-do. Women without wealth or connections would still go to butchers and sadists and coathangers.

With all the devices, medications, and practices available to avoid ovulation, fertilization, or zygote implantation in the first place, I have a bit of a problem understanding why government at any level has to get involved in adjudicating foetal assassination. And I REALLY have a problem with why taxpayers EVER have to pay for ANYbody’s abortion.

There IS no easy solution, but I’d endorse discernible foetal heartbeat as the criterion for establishing human life in utero. Terminating it past that point is, to me at least, akin to homicide . . . manslaughter at the very least, except where the life of the host is endangered.

IOW, if a woman can’t make a decision before the “lump of undifferentiated tissue” becomes viable, then she has to live with it, dammit.

  2. Given enough anti-murder justices and the realization that they would entertain a revisit of Roe (which everyone recognizes as a deeply flawed decision a la Dredd Scott) and it will come back, and good jurists will entertain the opportunity to fix it.
    And Bocopro said it well.
I don’t know exactly when “humanness” begins.
Some oppose birth control as a form of abortion because a fertilized ovum is forced to die.
    They could be right.
I think we should at least go for heartbeat.

  3. Kid says:

    What bocopro said.

It is beyond my understanding why partial birth abortion is not clearly fedined as murder. The bnaby is alive and they kill it. Whether it is 1 second after birth or 10 years, it is the same thing. There can’t be many people who support this practice.

  4. jerrydablade says:

It might be ‘unusual’ for the SCOTUS to take up Roe v Wade, but not impossible. Look how far to the left we have fallen in such a short time. And I think outwardly stating one’s opposition to infanticide SHOULD be a litmus test. Should Stare decisis be used to excuse the selling of baby parts? WTF is wrong with ‘deep sixing’ this abhorrent and evil law that was never based on the constitution to begin with? Where would that slippery slope stop? If the right to life is a slippery slope, then grease me up and hold my beer.

  5. It may not be Roe specifically comes up, but remember, Roe was about first trimester abortions, and look what we have now.
There were no sonograms when Roe was thrust on us.
If we got to “heartbeat”, it would be a yuuuge win.

  6. bunkerville says:

I doubt that the Supremes will change course.. Roberts will simply ride it out as settled law. What they may do as determine it is a State matter and return the decision to them. Thats about the best we can get… I don’t doubt for a nanosecond if we don’t get a candidate in by the election this fall, there will be complete mayhem and civil unrest the likes of which we have never seen.

  7. geeez2014 says:

Bunkerville is right…..It won’t change course; it won’t even be brought up. This is a scare tactic. Yes, they COULD sent it to the States.

Bocopro…I have a REAL PROBLEM with paying for babies to be murdered, too, BELIEVE ME.

Ed, I do not believe any justice wants to relive that fight. You could be right about yet another bill, not exactly “Roe” but I strongly doubt it.

Jerry; the fact that, as you say, we’ve gone so far left, makes me think SCOTUS will NOT entertain another abortion suit.

Putting partial birth abortion aside (how can ANYBODY EVER think that’s a good idea???) I really do not think this will come up again at SCOTUS. Should it? Probably…
The Left are people who’d kill a life 2 seconds before it entered the birth canal, but once it’s born, 2 millimeters out of the birth canal, would scream for a doctor to help (If there’s a problem) or , as Obama voted for, kill the child since nobody wants it. (wasn’t there some bill about that in Illinois?)

ALSO, the Left will protect illegal babies to the death, but commit abortion in a heartbeat of American (particularly Black) babies.

As if BAD PEOPLE will be upset they can’t get OUT? As if they’re LEAVING? If we catch them, WE WILL DO WHAT WE HAVE TO. If sending them out is the plan, I’m sure we can arrange that, wall or no wall!!

  8. geeez2014 says:

I mentioned how FOX’s Eric Shawn is a lib stooge and I think I’m right…this morning, again, he insisted on their discussing how Trump said “Dems want Open Borders…and isn’t that untrue?”
what a creep he is. Can’t believe I was so right on him so long ago. I can SMELL A LIBERAL A MILE AWAY from the sublest hints and it ain’t pretty 🙂

  9. bocopro says:

Just somethin ‘bout Eric Shawn that triggers the distaste cilia in my news nostrils. Donno what it is . . . just don’t like the guy; ergo, I avoid watchin him. Consequently, I ain’t qualified to discuss him. Can’t argue with “creep,” though.

He’s kinda like Chris Wallace to me – just rubs agin my grain or somethin. Very likely a qualified, experienced, decent reporter/commentator, but I just don’t like him. Switch channels or go do somethin else when he appears on my screen.

In fact, of all the reg’lar crew doin news reporting or analysis on FoxNews, the only one I’ll pay any attention to is Baier. McCallum’s o.k., but she got into the interview business, so I don’t give her any time any more.

  10. geeez2014 says:

Bocopro…I’ve called him THE LEPRECHAUN for ages…but I’ve really seen the left angle, he is HAMMERING on how the “Democrats REALLY didn’t say they’re for open borders” for DAYS.
Another guy on the scene in W. VA. reported the same thing.
Those who are writing their lines are NOT CONSERVATIVES…The leftwing Murdoch family who took over from Dad is WINNING.

Yes, Baier is solid, excellent, fair. McCallum, too, but I like her interview ‘business’ because she will straighten libs out from time to time, which I LOVE. Also Sandra Smith, Harris Faulkner…Neil Cavuto (Tho he goes off my plantation sometimes, rarely, but sometimes…and HE IS HONEST about Trump as I AM, sometimes a bit harder than I would be ON THE AIR, but…) I love his self effacing humor.

I have a very hard time with Jeanine Pirro…now even more, since she’s hawking her new book, which is probably something all of us could have written.

  11. geeez2014 says:

AGAIN OFF TOPIC: This is the kind of thing presidents should avoid: ‘If not for me, we would now be at War with North Korea!’
OMG. It could BE, but please, Mr. President……calm DOWN your ego!! But say it…fine…like “I’m very pleased that what I and my associates are doing may have probably kept us from war with N Korea…this is something any president must aim for.”

DOne. Got the point across, looked humble (look it up, Donald) , and is true……………….possibly.

  12. geeez2014 says:

OFF TOPIC (I’m on a rol! like corned beef on a Kaiser!) , I saw this article ( and read it…the last paragraph says :

“Either way, I salute Harper for her continued advocacy for trans inclusion and her willingness to appear on Fox News, connecting with an audience a majority of whom I’m confident in saying does not inherently believe in transgender athletes participating equally in sports.”

WHAT? Conservatives don’t want transgender athletes participating EQUALLY? let them! But they have to play in teams of THEIR GIVEN SEX… WE DO want them participating EQUALLY in high school….boys compete with BOYS, not with GIRLS who are NOT BOYS and have a physical disadvantage. Gosh, I HATE this crap.

  13. Baysider says:

“The wall keeps people in” ??? Does she think we live in East Berlin?
It would take more than a tidal wave for the court to reverse on Roe. They have enough new hot potatoes coming their way. As for my part, I’m prayin’ like crazy for the nominee. THIS is the election consequence we all put our heart and wallets into. (We cannot afford the first Sotomayor, much less a sequel. That idiot actually compared the travel hold of foreigners from a few radical hotbed Muslim countries to Korematsu, the Japanese internment decision affecting citizens!!)

  14. geeez2014 says:

Baysider, isn’t that hilarious!? I was stunned and laughing at the same time!

I agree about Sotomayor, of course, and praying about the new justice….Blogger Bunkerville is following the history of Judge Kavanaugh, who seems to have a good chance of nomination…he was behind much of what many feel was a cover-up about Vince Foster, etc., so that’s worrisome….talk about DEEP STATE, IF (IF) it’s true.

  15. Mal says:

It’s noon and I just logged on and read the blog. I mentioned once before when this subject came up a few years back, the government should stay out of a woman’s body. When abortions were illegal, girls (esp. high school girls!) would still get them. I remember when I was in high school in L.A. during the 1940’s girls went to Tijuana to get one because it was illegal here. Now wouldn’t it have been better for it to be done in sterile surroundings by qualified personnel?
I’m sure I’m the oldest of your bloggers so this probably comes as a surprise to most of you. I don’t like it any more than you folks, but given the alternative……………………..

  16. “Yes, they COULD sent it to the States.”
No they can’t. That was the whole point of Roe. To take it away from the states.

  17. geeez2014 says:

That’s just one article that supports the conclusion of many legal experts.

  18. Mal says:

  19. Kid says:

Mal, I saw a little video somewhere of one of the potential judges – Amy Barret, talking about it a couple? years ago and saying there might be potential to shut down late term abortions.

  20. geeez2014 says:

Kid, I hope that’s true…….Shut down late term ….I suppose that’s partial birth, right? Because partial birth is babies in the birth canal! 😦

MAL: I am so conflicted on this. I KNOW FULL WELL (we all do) that banning abortion only sends women to doctors who’ll do it anyway… …but is that a reason to approve of killing babies? UGH.
I despise the knowledge that my tax dollars are paying for abortions. And I hate to hell how Planned Parenthood lies and even when caught wiggles out of it.

And I think passing it to the States is a HUUUUUUUUUUUGE COP OUT.

  21. kid says:

I don’t know the specifics Z, Certainly that. but there are also babies that are out and breathing that are killed or left to die. I find that the legal system not being able to deal with that as unreal.

  22. geeez2014 says:

Kid, you’re exactly right! I had heard there was some bill about if babies survived an abortion they should be left to die…that’s the testimony of many nurses, many on YouTube, too. The bill protected doctors who let them die. And I know that was something in Illinois that Obama voted FOR. That that goes on is totally ‘unreal,’ isn’t it.

  23. geeez2014 says:

In rebuke to Trump, key Senate panel endorses finding that Russia attacked 2016 election

WASHINGTON — The Senate Intelligence Committee, rejecting doubts conveyed by President Trump as recently as last week, has become the latest body to officially conclude that the Russian government conducted a wide-ranging campaign — including cyberattacks — to influence the 2016 presidential election.

An unclassified seven-page report, released by the committee Tuesday with full bipartisan support, was based on an extensive, year-and-a-half-long investigation into the U.S. intelligence community’s January 2017 assessment that the Kremlin carried out its campaign in part for the purpose of promoting Trump’s candidacy and discrediting Hillary Clinton.

The committee’s conclusion: The assessment, which had been ordered by President Obama, is a “sound intelligence product” that was prepared by analysts who “were under no politically motivated pressure to reach any conclusions” and was based on a “range of all-source reporting,” albeit much of it still classified.

The panel’s findings are hardly a surprise. All of those who have reviewed the January 2017 intelligence community assessment — including the most senior officials of the Trump administration — have endorsed the conclusions that the Russians hacked the Democratic National Committee and undertook a wide variety of other measures to interfere in the U.S. election.

  24. kid says:

The report is BS Z. Mueller still can’t come up with any evidence against the Russian company(s) and individuals who he indicted who came to the US court to smile at him and file for discovery, which he still hasn’t provided. He’s a joke and a tool. He’s on a mission to frame Trump.

I don’t even believe they hacked the DNC. Assange said that info did not come from a state actor and I believe him. I believe it came from Seth Rich.

Finally.., Intelligence community?? As in Comey, Clapper, Wray, Brennen ?? Those Trump Derangement people? Please! Not buying it.

Even if it was true, who cares? Countries have been trying to screw with other countries for a long time. No bad news here,

  25. Mal Telloian says:

The ones I’m talking about certainly aren’t late term. I’m definitely against that, but its still in a woman’s body, ergo, her “property”………… least until it is born and breathing.. Therein lies the problem. So when it has a heartbeat but not breathing, it okay, but not after it takes its first breath?
This is where the law and religion might buck heads.

  26. geeez2014 says:

Kid, here is the bad news: What they say goes. Who else is deciding anything? We (and Trump) are basically at their mercy. I had the same thought you did, at first, then I remembered “That’s the committee…and all others have said the same thing……….” What will happen now? Who knows? Hopefully, it’ll be like any senate hearing and it just fades away….
Honestly, for Trump to be SO cozy with PUtin (basically agreeing with Putin on Crimea, not getting on him for tons of bad stuff Putin’s done, wanting to meet with him) if he DID collude with him pushes the envelope. Liberals REALLY THINK Trump would try to be this friendly with Putin if he HAD done anything wrong??

Mal…If we could answer your questions, wouldn’t we all be famous? Maybe NOBEL PRIZES!! Except Nobel judges are all leftwing and probably atheists and probably for euthanasia, etc, right!?
There IS no Bible verse saying “Thou shalt not commit abortion!” But we DO have “Thou shalt not kill,” and therein lies the religious rub!
WHEN IS IT KILLING? Seems to me like once something has a beating heart, that’s living….

I also believe women should make their own decisions about their souls, not their bodies. If they want to mess with God, or don’t believe in a god, and decide to get rid of a life within them, that’s their choice and God help them! I JUST DON’T WANT TO HELP THEM$$$$$

  27. kid says:

Z, I’m well aware of the $$ feeding frenzy that has been going on in America for at least 9 years.

To your earlier comment, the libtards still think ‘a storm’s a comin’. LOL

Why do you think the Russia thing is bad news? Countries can do all sorts of things, and unless they can specifically tie it to Trump there is zero basis for impeachment. Where does the bad part come in?

    Liked by 1 person

  28. geeez2014 says:

BUT KID! The whole point is to FIND OUT WHAT RUSSIA DID…AND WAS THERE COLLUSION? Do you think it’s important that we find out exactly how much Russia can do in elections? OF course, the main point is: Why didn’t Libs care when Obama (it’s been proven) told his staff to kick this can down the line and let the next pres deal with it)? Suddenly, TRUMP IS ELECTED, and NOW they act? 🙂

SO…IF THEY DO PROVE RUSSIA SOMEHOW PUT TRUMP IN (WHICH I THINK IS UTTER RUBBISH, BY THE WAY), THEN WHAT? It’s not for FUN these stupid committees are convened to decide something, right?
You really want half of America to think Trump got in because of Russia finagling? THAT is BAD, no?

  29. kid says:

Mueller has been trying to find collusion for 2 years, can’t find any, but we all know the clinton campaign and the DNC colluded their —-es off. I actually don’t think it’s important we find out what Russia can do. I think it is more important to have a iron clad voting system. When our voting system is a screwed up as ours is, 15 yr old kids can mess with it.

Why didn’t libs care? Z, Libs Don’t Care About Anything. Nothing. They jump on anytihing they think they can use as a weapon even if they did the same thing 10000 times worse yesterday. Right?

How can anyone Prove Russia Put Trump In? Serious question. They’ve all already said No Tampering with Election Machines. Facebook ads? That doesn’t amount to putting someone in?

I don’t give a * what the left thinks because I already know what they think. How is it “bad”?
They’re never going to vote for America so who gives a fish what they think? “America” is either going to vote itself back into existence or it ain’t. And if it doesn’t, then it can have this transgender bathroom. I don’t care either way. I’m just watching the show. But I do think the left is disintegrating. Watch and see how much that socialist chick in NY gets voted in. Who odly enough has aspirations for the White House ! LOL Dellusional.

And hey if Bernie or a reasonable facsimile gets voted in then great. I’d love to start social security at twice the amount it is currently slated to be. I’ll be dead before we turn into Greece and the rest of the inhabitants can figure out what they’re gonna do. Every generation has it’s own environment (that they make) and their own challenges. Ain’t no hand-wringing going on at my house.

  30. Jean Worland says:

As I read through these comments, it seems that God has been totally left out of the discourse on the rightness or wrongness of abortion and perhaps rightfully so since the subject is about the subject of someone appointed to the Supreme Court who might want to overturn Roe v. Wade.

But I think it is worthwhile also look at what God thinks of killing His progeny in a mother’s womb, which womb He also made There are several scriptures that let us know exactly what God thinks: “For You created my inmost being; You knit me together in my mother’s womb. I praise You because I am fearfully and wonderfully made; Your works are wonderful, I know that full well. My frame was not hidden from You when I was made in the secret place. When I was woven together in the depths of the earth, Your eyes saw my unformed body. All the days ordained for me were written in Your book before one of them came to be (Psalm 139:13-16).

Did not He who made me in the womb make them? Did not the same one form us both within our mothers? (Job 31:15).

Hopefully something to think about, Jean Worland

  31. geeez2014 says:

KID, Can’t argue with anything you said.

Jean, Oh, yes! Most of us are believers here and we do think about this, very much! But, today, I just wanted to talk politics, about how the Left is USING “Roe v Wade” and their scaring everyone that “IT WILL BE OVERTURNED” as a weapon……..a silly weapon because, as Marc Levin and others say, it probably won’t come up to the SCOTUS again.
This is NOT about abortion with the Left today and the Supreme Court candidate….it’s about NEVER HAVING A CONSERVATIVE COURT..EVER…… they’re using abortion as the big threat to lefties who’d rather die than not kill babies!

I wish there’d be a huge revival…….perhaps it could………..but, as of today, we have PRAYER and we have talking realistically about the best we can get for this country in a new Justice.

  32. Baysider says:

In a rare listen to Mark Levin I heard him express concern that the Bush crowd and another more suspect RINO contingent is pushing very, very hard for Kavanaugh. He was careful to say that makes him think we need to be sure other strong candidates get the full vetting we deserve and not hidden behind a RINO smokescreen.

Sigh … I could ONLY WISH Janice Rogers Brown were 20 years younger. She retired from the federal bench last year after having spent years being tee’ed up for a position on the SCOTUS. And it was a bruising fight to get here there at all.

  33. Baysider says:

If Putin put Trump in office, I’m sending a dozen roses. 🙂 🙂

  34. Baysider says:

But of course I don’t believe that. He already bought and paid for the other candidate.

  35. geeez2014 says:

Baysider, yes, Kavanaugh’s also implicated in some things that we’d NEVER want to have in a Justice…Bunkerviille’s link above has information you’ll be interested to see.

  36. Mal says:

Z, when I posted quite awhile back the Bible says Tho shalt not Kill, someone corrected me by saying its “thou shall not commit murder”. I believe it was John who corrected me. By the way, where IS John, Z? We haven’t seen him posting anything in months.
We kill all the time, not only animals, but people. Sometimes by the hundreds of thousands during wars, but then thats okay. Its justified. The whole thing doesn’t make any sense that way, does it?
