Roe v Wade………and SCOTUS, of course

Mark Levin so well explains why Trump nor the Left need to make ABORTION the big deal with his coming appointment to the Supreme Court.  I’m going to explain why I think they WILL, however:

Sadly, Trump’s already today signaled to  Susan “Partial Birth is Okay!” Collins (do you know how awful partial birth IS?  She was for it…one of only 3 Republicans who voted not to ban it) and Lisa Murkowski that he has “broadened the list of possible Justice candidates”…obviously, it was a message to them that said “Don’t worry, I’ll find someone softer on it.”

Sounds like he’s caving already!  But Trump had better DARNED WELL be careful because his base is EVERYTHING to him and, possibly, the Midterms, so DO NOT BLOW IT ON THIS, MR. TRUMP.  I have a feeling he’s playing them along, however, because he’s more aware of the wishes of his base on this subject than we are, that’s for sure.

HERE IS THE DEAL, according to “THE GREAT ONE, MARK LEVIN”:

It would be very unusual if Roe v Wade even came to the SCOTUS.  Ever.   Most people with their eyes on the court, from both sides of Roe v Wade, know this.

The SCOTUS gets from 7-8,000 cases a year for their review.  They pick about 100 and send the rest back.   They’ll probably send this one back just because it’s huge and because they’ll not want to ‘go through that again’;  most say “this is settled law”    Not sure that’s pertinent, but that’s what’s said.

SO HERE IS WHAT I THINK:  Is the Left going to use ROE v WADE just to advertise to women and most liberals that THEY ARE MORE OPEN MINDED and, after all,  WOMEN HAVE A RIGHT TO DECISIONS ABOUT THEIR OWN BODY!!, knowing full well it won’t come up but they just plain DO NOT WANT A CONSERVATIVE ‘TRUMP COURT’ to decide anything for the next 40 years?

I THINK SO.   HOW DO YOU FEEL ABOUT THE ROE V WADE SITUATION AND THE SCOTUS AND TRUMP’S NEWEST CANDIDATE WE’LL KNOW ABOUT NEXT MONDAY?

    The danger in high courts reversing decisions of their predecessors is that it becomes a political teeter-totter with a simple Senate 51/49 majority picking judges for the primary purpose of reversing or ignoring rulings based on fads or whims.

    Doubt very much the SCotUS is interested in deep-sixing established precedent: once you enter that no-man’s-land, where does it stop.

    To me the whole thing is one of those “there ain’t no answer” quandaries. Making abortions illegal wouldn’t stop the practice, but simply make ridding oneself of an inconvenient pregnancy a privilege of the well-to-do. Women without wealth or connections would still go to butchers and sadists and coathangers.

    With all the devices, medications, and practices available to avoid ovulation, fertilization, or zygote implantation in the first place, I have a bit of a problem understanding why government at any level has to get involved in adjudicating foetal assassination. And I REALLY have a problem with why taxpayers EVER have to pay for ANYbody’s abortion.

    There IS no easy solution, but I’d endorse discernible foetal heartbeat as the criterion for establishing human life in utero. Terminating it past that point is, to me at least, akin to homicide . . . manslaughter at the very least, except where the life of the host is endangered.

    IOW, if a woman can’t make a decision before the “lump of undifferentiated tissue” becomes viable, then she has to live with it, dammit.

  2. Given enough anti-murder justices and the realization that they would entertain a revisit of Roe (which everyone recognizes as a deeply flawed decision a la Dredd Scott) and it will come back, and good jurists will entertain the opportunity to fix it.
    And Bocopro said it well.
    I don’t know exactly when “humanness” begins.
    Some oppose birth control as a form of abortion because a fertilized ovum is forced to die.
    They could be right.
    I think we should at least go for heartbeat.

    It is beyond my understanding why partial birth abortion is not clearly fedined as murder. The bnaby is alive and they kill it. Whether it is 1 second after birth or 10 years, it is the same thing. There can’t be many people who support this practice.

    It might be ‘unusual’ for the SCOTUS to take up Roe v Wade, but not impossible. Look how far to the left we have fallen in such a short time. And I think outwardly stating one’s opposition to infanticide SHOULD be a litmus test. Should Stare decisis be used to excuse the selling of baby parts? WTF is wrong with ‘deep sixing’ this abhorrent and evil law that was never based on the constitution to begin with? Where would that slippery slope stop? If the right to life is a slippery slope, then grease me up and hold my beer.

  5. It may not be Roe specifically comes up, but remember, Roe was about first trimester abortions, and look what we have now.
    There were no sonograms when Roe was thrust on us.
    If we got to “heartbeat”, it would be a yuuuge win.

    I doubt that the Supremes will change course.. Roberts will simply ride it out as settled law. What they may do as determine it is a State matter and return the decision to them. Thats about the best we can get… I don’t doubt for a nanosecond if we don’t get a candidate in by the election this fall, there will be complete mayhem and civil unrest the likes of which we have never seen.

    Ed, I do not believe any justice wants to relive that fight. You could be right about yet another bill, not exactly “Roe” but I strongly doubt it.

    Jerry; the fact that, as you say, we’ve gone so far left, makes me think SCOTUS will NOT entertain another abortion suit.
    ALTHOUGH, the LEFT KEEPS SAYING HOW MANY COULD VOTE AGAINST REPUBLICANS BECAUSE PEOPLE WANT LEGAL ABORTION, BUT SOME STATS SHOW THAT EVEN YOUNG PEOPLE ARE MORE AND MORE AGAINST ABORTION….

    Putting partial birth abortion aside (how can ANYBODY EVER think that’s a good idea???) I really do not think this will come up again at SCOTUS. Should it? Probably…
    The Left are people who’d kill a life 2 seconds before it entered the birth canal, but once it’s born, 2 millimeters out of the birth canal, would scream for a doctor to help (If there’s a problem) or , as Obama voted for, kill the child since nobody wants it. (wasn’t there some bill about that in Illinois?)

    ALSO, the Left will protect illegal babies to the death, but commit abortion in a heartbeat of American (particularly Black) babies.

    I JUST HEARD LIBERAL LESLIE MARSHALL SAY ABOUT ‘THE WALL’ THAT “LIBERALS DON’T WANT THE WALL, BUT WE DO WANT BORDERS…DON’T FORGET, THE WALL ALSO KEEPS PEOPLE IN, BAD PEOPLE, AND SO WE SHOULD CONSIDER THAT” I nearly laughed out loud.
    As if BAD PEOPLE will be upset they can’t get OUT? As if they’re LEAVING? If we catch them, WE WILL DO WHAT WE HAVE TO. If sending them out is the plan, I’m sure we can arrange that, wall or no wall!!

    Yes, Baier is solid, excellent, fair. McCallum, too, but I like her interview ‘business’ because she will straighten libs out from time to time, which I LOVE. Also Sandra Smith, Harris Faulkner…Neil Cavuto (Tho he goes off my plantation sometimes, rarely, but sometimes…and HE IS HONEST about Trump as I AM, sometimes a bit harder than I would be ON THE AIR, but…) I love his self effacing humor.

    I have a very hard time with Jeanine Pirro…now even more, since she’s hawking her new book, which is probably something all of us could have written.

    WHAT? Conservatives don’t want transgender athletes participating EQUALLY? let them! But they have to play in teams of THEIR GIVEN SEX… WE DO want them participating EQUALLY in high school….boys compete with BOYS, not with GIRLS who are NOT BOYS and have a physical disadvantage.     It would take more than a tidal wave for the court to reverse on Roe. They have enough new hot potatoes coming their way. As for my part, I’m prayin’ like crazy for the nominee. That idiot actually compared the travel hold of foreigners from a few radical hotbed Muslim countries to Korematsu, the Japanese internment decision affecting citizens!!)

    It’s noon and I just logged on and read the blog. I mentioned once before when this subject came up a few years back, the government should stay out of a woman’s body. When abortions were illegal, girls (esp. high school girls!) would still get them. I remember when I was in high school in L.A. during the 1940’s girls went to Tijuana to get one because it was illegal here. Now wouldn’t it have been better for it to be done in sterile surroundings by qualified personnel?
    I’m sure I’m the oldest of your bloggers so this probably comes as a surprise to most of you. I don’t like it any more than you folks, but given the alternative……………………..

    MAL: I am so conflicted on this. I KNOW FULL WELL (we all do) that banning abortion only sends women to doctors who’ll do it anyway… …but is that a reason to approve of killing babies? UGH.
    I despise the knowledge that my tax dollars are paying for abortions. And I hate to hell how Planned Parenthood lies and even when caught wiggles out of it.

I actually don’t think it’s important we find out what Russia can do. I think it is more important to have a iron clad voting system.     And hey if Bernie or a reasonable facsimile gets voted in then great. I’d love to start social security at twice the amount it is currently slated to be. I’ll be dead before we turn into Greece and the rest of the inhabitants can figure out what they’re gonna do. Every generation has it’s own environment (that they make) and their own challenges.     As I read through these comments, it seems that God has been totally left out of the discourse on the rightness or wrongness of abortion and perhaps rightfully so since the subject is about the subject of someone appointed to the Supreme Court who might want to overturn Roe v. Wade.

    But I think it is worthwhile also look at what God thinks of killing His progeny in a mother’s womb, which womb He also made There are several scriptures that let us know exactly what God thinks: “For You created my inmost being; You knit me together in my mother’s womb. I praise You because I am fearfully and wonderfully made; Your works are wonderful, I know that full well. My frame was not hidden from You when I was made in the secret place. When I was woven together in the depths of the earth, Your eyes saw my unformed body. All the days ordained for me were written in Your book before one of them came to be (Psalm 139:13-16).

    Did not He who made me in the womb make them? Did not the same one form us both within our mothers? (Job 31:15).

    Jean, Oh, yes! Most of us are believers here and we do think about this, very much! But, today, I just wanted to talk politics, about how the Left is USING “Roe v Wade” and their scaring everyone that “IT WILL BE OVERTURNED” as a weapon……..a silly weapon because, as Marc Levin and others say, it probably won’t come up to the SCOTUS again.
    This is NOT about abortion with the Left today and the Supreme Court candidate….it’s about NEVER HAVING A CONSERVATIVE COURT..EVER……..so they’re using abortion as the big threat to lefties who’d rather die than not kill babies!

    I wish there’d be a huge revival…….perhaps it could………..but, as of today, we have PRAYER and we have talking realistically about the best we can get for this country in a new Justice.

    In a rare listen to Mark Levin I heard him express concern that the Bush crowd and another more suspect RINO contingent is pushing very, very hard for Kavanaugh. He was careful to say that makes him think we need to be sure other strong candidates get the full vetting we deserve and not hidden behind a RINO smokescreen.

    Sigh … I could ONLY WISH Janice Rogers Brown were 20 years younger. She retired from the federal bench last year after having spent years being tee’ed up for a position on the SCOTUS. And it was a bruising fight to get here there at all.

    Z, when I posted quite awhile back the Bible says Tho shalt not Kill, someone corrected me by saying its “thou shall not commit murder”. I believe it was John who corrected me. By the way, where IS John, Z? We haven’t seen him posting anything in months.
    We kill all the time, not only animals, but people. Sometimes by the hundreds of thousands during wars, but then thats okay. Its justified. The whole thing doesn’t make any sense that way, does it?
    ITS CRUEL OUT THERE.
